Hello Guys,

Since my wife does not meet the income requirements my aunt is co-sponsoring so she has to file I 864a.

I was going through the form and just wanted to know which part my aunt needs to fill. Although she does not live with us she can sponsor us right??

Will she fill out Part 2 and Part 5 and I fill out Part 1 and Part 6. How does this work?? Also, all she needs to provide is 3 years of tax return and then I will put in data from her tax return to complete 864.

Thanks

Even though your wife does not meet the income requirements, she would still have to fill out I-864. Your aunt would be a joint sponsor. She does not leave with you, so she can't fill out I-864A, she has to fill out another I-864. You can get the information here: http://uscis.gov/graphics/howdoi/affsupp.htm

Now I am confused. i thought she will file 864a and my wife will file 864. You are saying that both my aunt and my wife will file 864. So there is no need for 864a.

No, you don't need to fill out I-864A since your aunt does not live with you. I-864A must be filed only by a household member if his/her income is used. So, you would file 2 separate I-864 forms: first one filled out by your wife; second one - by your aunt.
Read the links I gave you.
