Hello guys

My wife is preparing i864 for me but her income doesnt meet the requirements so along with her my father in law is also going to be a joint sponsor.

They live in the same household. As my wife will be filling i864 and he will add her father's
income in total household income.I have a simple question that which form does my father in law need to fill i864 or i864A ?

My second question is that how do i calculate the household size ? my father in law is filling tax jointly with her wife and have 2 dependent so how many household members number does she need to fill in form i864 pg #3 question 21 option g ?

1, 2 or 4 ?

Do you live with your wife? Are you in this household too? If you are the I-864A will reflect the 4 members.

I'm the immigrant and my wife is sponsoring me.

She has filled i864 but her income doesn't meet the requirement so her father who lives in the same household will be the co/joint-sponsor filling i864A
but problem is that her father has 2 dependent

So the question from form i864 pg # 3

How many numbers should i put in ?
One because my wife has only one joint sponsor who is her father ?
Or Three because the joint sponsor has 2 Dependant ?

For a family-based case, the household size will always be at least 2 -- the citizen/LPR sponsor and the intending immigrant.

In your case, add one more (her father) to make it 3 because he is filing I-864A. His dependents don't need to be included.

Does she have any children, or was there anybody else for whom she has filed I-864 or I-864A in the past? They also may need to be added to the household size.

Are you sure because when i called nvc operator she said dependents need to be included :confused:

No she doesnt have any children nor she has filed i864 or i864A in past

Her father is filling the taxes jointly with her mother so do we need to include her ?

If he was filing I-864 his dependents would have to be included. But I-864A doesn't include them.

But his spouse might have to be included because of the joint income .... let me check that out.
 
If I sand I864 joint Sponsor would that work. or they still need proof of relationship

the sand me Checklist asking for I864 on August 17, 2011

then anther one ask for I864 and proof of relationship for I864A on August 20,

If I sand I864 for joint sponsor do they ignore the I864A

If the joint sponsor files I-864 they won't need to provide proof of the relationship, but they still need to provide proof of their finances and US citizenship or LPR status. Also, a joint sponsor filing I-864 must have enough income and/or assets to meet the requirements without combining funds with the immigrant or petitioner. Whereas if they filed I-864A they can combine funds.
