Hi team,
I need a advice from your end ,My employer filled for my h1B visa, and we got it approved only problem is we got i797B without I-94 although i am already in US with my H4 I94 expiring in 2012 ,also somewhere on the Forums it was mentioned that if you have I797B you will not get the SSN number, also I797B states that "if any of the workers are already in the US the petition can file a new Form I-129 to seek to change or extend their status based on the petition".
But now i got my SSN number as well ,does it mean i can work in US without going out for filling a ammendment for the same. Also can you tell me why i got I797B not I797A even though my employer claims that they check the radio button which says change of status.

Also what is my current status now?
If I starts working on a project how will INS determine that ?
Can i start working on a project and than go out of the country and get my Visa stamped as i dont want to take a risk now of going out and coming back?

Regards ashish paul

You dont have I-94 attached with H1 approval notice. It simply means you are not on H1 status and your status is not changed from H4 to H1. you are still on H4 status. if you want to work on H1 then you should be on H1 status. go out of US, get H1 visa stamp enter on H1 status. You are not allowed to work on H4 status. How did you got SSN??
for more info you should talk to your lawyer who filed H1.

Given that you proposed to work illegally - i.e.without proper I-94 authorizing you to do so, how do you feel about accepting the consequences of illegally working in the US?
