I765 - Previous employment auth. from USCIS

Dear all,

Im by sending all the I130 and I485 package, including I765, and I have a big doubt with this part of the I765 form:

11: Have you ever before applied for emplyment authrization from USCIS? If so, attach all documentation.

I had an L1B blanket petition from my employeer, but I cant find the documentation they had sent to me, and when I called them to see if they could send me those documentation again they are saying that they dont have it anymore...

My question is, when they made all the process for my L1 blanket petition, did they applied for an employment authorization from USCIS right? So I should mark it as "yes", but how could I explain them that I dont have those forms?? could be they deny my work permission due to this?? Whats the best way you think I could manage it??

Thank you a lot in advance, Im really worried because I need to start working asap and whatever delay will be a pain.


PS: im applying for a C9 change status.
 
Did you ever get actual EAD? Not L1, H1, whatever, but EAD (the card)? For example I had EAD after I finished the school (as OPT), so I put the info about this EAD on form. If you never had EAD you shouldn't put any info. As far as I understand L1 has nothing to do with EAD.

My employeer didnt sponser any EAD card. But I worked in the USA under a L1 blanket petition, and therefore in the past my employeer applied me for a employment authorization from USCIS (I think), then my doubt is if I have to mark YES in the question Have you ever before applied for employment authorization from USCIS? but the problem is that.. i dont have any form or documentation to attach.
 
L1 doesn't count as "employment authorization" for the purpose of the EAD application. They are asking if you applied for an EAD before.

Is it not a kind of employment authorization from USCIS???

Sorry if Im asking so much, but currently I have no money to pay a lawyer, and need the work permission urgent, and a delay in it will affect me greatly.

No, L1 petition (blanket or not) is NOT an Application for Employment Authorization. They are simply asking if you ever filed an I-765 form before. So in your case the answer is NO!

Well, yes and no. It IS employment authorization in sense you can work in US under L1 (or it was F1 and H1 for me), but only for the employer who sponsored you. It's NOT EAD (which allows you to work anywhere). EAD is when you have to submit a special form (751), and only VERY FEW categories can do it (like I said OPT for students, immigrants, I believe refugees and such, etc). Employer cannot submit request for EAD. So just put "No".
