I601A Waiver of unlawful presence

Everything has been going smoothly up until Oct 2013 when we inquired as to why webhadnt heard anything about my husbands waiver or biometric appt. Turns out they sent an appt to an incorrect address in July 2013 and since he didnt turn up he was denied in October 2013 and we didnt get that notice either. So they had the wrong address it took us and our attorney awhile to get it changed and they sent us copies and told us they would check the error and reopen the case. Today we learn that the USCIS said they didnt make an error and we have to apply again and pay again. Even our attorney of record didnt get the paperwork. Does anyone know how we get passed this? Our attorney is useless and I feel isnt fight for us and just says file again. The paperwork that went to our attorney with the denial still has the incorrect address and Im at a loss to know what to do now. Any help would be appreciated because if we have to oay we have to pay but what if it happens again??

Gee, don't you think you need another lawyer. You should request an INFOpass appointment and explain to the officer you meet (show all the evidence) and hopefully that will make it clearer to them that they erred (I am wondering what makes the USCIS say that they made no mistake because maybe they didn't and it was your attorney's mistake). Do you have copies of documents proving that these are the ones submitted to them while they mailed it to someone else?

We have had info pass appointments to try and change the address, they tell us it was changed but in actual fact it wasn't. We want to change attorneys but don't want to pay again to start the process over. I can't believe the USCIS are so incompetent. I don't understand either how our application paperwork has our address but they sent it to a PO Box and we can't call anyone to fix it. Info pass apps don't help,as they can't give any info to us. They are. Not allowed to even give us copies of paperwork.
