Actually i am working in for a company in the west coastand my wife is working in the east coast. My greencard processing is currently pending. My company is transferring a lot of the work to India development center and they are looking to reduce the number of employees here in the US. As a part of that they have announced a voluntary separation program in which employees can chose to volunatarily leave the company for which they will get a good financial package.

I want to find a job in the east coast where the job market is better than here and i can also stay together with my wife and am thinking that this is a good oppurtunity for me to move. The only problem is that it is remotely possible that there could be some obstacles to my green card processing if i decide to do so if i dont get a job soon.

So at this point i just need to make the decision whether i should take the voluntary termination package or not. I am thinking that it will be better if i take it, but if i do, i need to be able to find a job in the eastcoast without any obstacles.

Please advice me on how safe it is to take voluntary separation at this point where my Greencard is pending from almost one and a half year(RD jan6th 2002).
Also if I do not find a job immediately . How will it effect? Please let me know

Is it OK to quit the company Voluntaryily or Is it necessary that u can switch jobs only if the Company does not want your services.
Please let me know ....
Also GURUS advice me as to how safe is this .
I have to make an immediate decision .

Before approval - it does not matter if you quit voluntarily or not - only you would need to find a similar job as described in your labour if your application is pending more than 180 days.


After approval - this might matter - if you quit the employer - than you won't be able to show intent to stay with the employer after GC - while if the employer terminates you - then you are quite safe in that regard.

Good luck in finding a job and reuniting with your wife.

AC21 can be used if you are laid off or if you change the job on your own. AC21 might be safe if all the BCIS offices get the highly hyped memo of Efran Hernandez (you might be aware of this if you would have followed this forum last week)

Most probably you might get the approval before you decide to quit. Goodluck!!!!!
