It is ONLY filed by someone eligible to pay the penalty fee and adjust under INA 245(i) which requires having had a petition or labor cert (LC) filed prior to the sunset date which was April 30, 2001. Some may be "grandfathered" if based on an earlier petition or LC and could file a new petition. Not many folks still qualify.
