I485 receipt Notice filed in Dec04

Hi Guys,
These forum has been a great help. My company filed my
I185/EAD/AP in the end of Dec'04. I have a plan to travel
out of US on Jan27' 05. I heard that I need to have the
receipt of the I485 before travel, I have a valid visa stamp on my passport.
I know I can return on that Visa.
Q. How long does it take to get the receipts.
Q. If I don't receive the receipt can I still travel without affecting
my 485 process.
Need urgent help pls.

Since you have a valid visa stamp you do not need the I-485 receipt with you. This has NO affect on your 485 or your entry in the US.

Raj,

You have valid visa..thats all...you dont need anything else..

Then I think I can go without worrying about my 485 processing.
Sometimes attorney does not have clue or what ?
My attorney hired by company was discouraging me to travel
and when I have explain him about some of the articles he does not respond.
His only response was, it will not be advisable to travel until u get AP or receipt. That makes you feel that there can be a problem.

Hi Gousgc,
I think u are right. But I was excited to get the 485 and all thing
going together and we filed all together knowing the travel plan.
I think I can not do anything right now other than waiting, since I have to travel. Does it going to affect my 485.
Before filing, I called the Uscis cust service no abd asked the question
about AP getting rejected and she told me that No it will not be rejected
since u are going on H1 and by the time u returned I can have the Ap to
according to her it was good to file before going. I was not satisfied.
Next day I again called and got a guy and he also told me the same answer.
If i read on immigration sites it says u have to be in the US from the time
AP is filed till it is approved.
The uscis rules s???? anyway still I can not convience myself what is right?
I haven't asked the attorney ?
 
Hi raj

The bottom-line is you can't use the AP when you leave USA before
it's approval. So, for your current visit, you don't need AP.
But for your next visit you can use it ( if it happens with in a year, if your
current visa expires).
