I485 processing - urgent please

Checks chased on Oct 2. USCIS received my package on Aug 15th.

Till June 2003 I was working for Company A, during those periods they filled my labor and I 140. My I140 was got approved in Sep 2004(after I left the company)
Again I joined with the same Company A on July 2007 and filled my I485. I got my receipt number on my checks. While join with this company they weren’t able to confirm me whether they have substituted my labor to some one else or not. The reason is after I left the company so many HR , Resource Manager and Attorney are changed.
So they do not have any records of mine. When we contacted old Attorney ( who filed my LC & I140) she said she haven’t used my LC and same with current Attorney. Still we are not sure my I140 is valid or not. My current Attorney said only way we can know about the validity of I140 is to apply 485. But anyway I took a risk and filed my 485.

My questions is ,

On what stage I can be sure still my I140 is valid and UCSIS will proceed with my application for processing?

If my I140 is not valid, will they deny EAD itself?

When will I come to know about this.


Experts please help me.
 
Check for the 'A' number on the I-485 receipt. EAD is not directly related to I-140 and this will be issued. You will get an I-485 RFE in case the I-140 is invalid.

there was no 'Alien' number in my I140. I might have to wait until i get receipt for my 485 to see 'A' number in that.

So if i get 'A' number in my 485 receipt which means my I140 is valid?

As long as the employer/attorney (old/new) can confirm that they did not retract your 140 after you left the company, you should be fine. Once the 140 is approved, its of no value to the company, and 140 goes with the candidate. There are some procedures based on that the 140 can be ported etc..

Just like manwithnoname confirmed, keep a close track with your 485 and have faith. If things are smooth and ok, then you might not get an RFE pertaining to 140.

Since 485 is already filed, there is not much you can do at this juncture than to wait.
