I485 priority date question

Hi,

I submitted I-140 and it was received on july 5, 2007. So since now the visa number is current I will submit I-485 too.

My question is since July 5 2007 will certainly be backlogged in/after august, what visa number will be in fact based to review my I-485? It is the visa number (current) now in July, or it has to wait to be approved until July 05 2007 becomes current again a long time later?

Another question is does anybody know whether I-485 can be filed concurrently with I-130 (family-based immigration) and get EAD approved based on that?

First question: After July becomes backlogged, they may still process you case, but you will not get final approval (i.e. an immigrant visa number from the DOS) until July 2007 is current again, which is anybody's guess.

2nd question: It depends on what type of I-130. If not subject to the numerical limit (spouse or young child of a US citizen), then yes you can file concurrently. Otherwise, under the current visa bulletin, you cannot.
