I485 pending more than 180 days, but no EAD. what happen if get layoff

my I485 have been pending more than 16 months. i have not applied the EAD since my company lawyer said i didn't need it because my H1 have long enough time before i got approval.

if i get lay off now, what will happen? can I find another job ?

You should apply for an EAD ASAP,there is no harm in it (You can use it in rainy days).You can apply through you lawyer or yourself too (form I-765).
Can you give us more details which service center etc. your case is in.

what happen if they ask me ref, but i have been layoff and no job? or i don't have EAD at that time, i cannot find job ? or i find a company but waiting for them to transfer H1 so that i cannot work?

Since ur 485 is filed so u stay in US legally;If u get EAD u can start working immediately and do not have to wait for H1B transfer.

I understand ur concern about RFE and u have no job.Best thing would be talk to lawyer and see what RFE is about.If they want a job letter or something u shd talk to your prospective employer and get a letter from them to reply to that RFE.

Get a copy of your I-485 receipt and I-140 approval notice and apply for EAD yourself ASAP. It is very easy. You only need to fill out a one page app. EAD will help you tremendously in finding a job in this tough market.

i will go to apply my EAD now. and i will keep update what happen on my status here.

hopefully i will get the EAD / i485 approved before i lose my job.
