Hey guys, when filling out i485 and the spouse changed her name from her maiden to husband's does she need to write her husband's name in field Part1? Or her maiden name . How it will be reflected on the green card ?

If she has already changed her name she should use the new name on the I-485.

Form G-325A has questions for other names used and maiden name, so should list her maiden name there in the appropriate section.

Thank you for such a fast reply ! We went to DMV and they said they will change only after she gets resident status , and she doesn't have social yet. In Court people say that for SSN and DL marriage certificate is enough . So what would be the right procedure to get her married name on the green card ?

In Court people say that for SSN and DL marriage certificate is enough .

For noncitizens applying for SSN and DL, the marriage certificate is usually NOT enough to get a name change; they also want to see a valid immigration document with the new name.

So she should apply for the I-485 and EAD (I-765). The employment authorization card and I-485 receipt will then have her new name, and she can use one or both (depending on the DMV rules of the particular state) to get a DL with her new name. The employment card with the new name plus the marriage certificate will enable her to get the Social Security card. The SS card will have some employment restriction wording on it.

Then after GC approval, she should visit the SS office with the GC to apply for an unrestricted SS card.

Form I-130 part C line 1. should show her legal name after marriage and Q.7 should show her maiden name (before marriage). Form G-325A on top part where it says family name and first/middle name should show her after marriage name and underneath where it says all other names used you can mention her maiden name (before marriage)

So if she puts in i130 on line C 1 her married name then this name will appear on her GC?
