I485 Filing...

A friends company is saying that they will file his I140 now but will file I485 only a year later. They are doing this to make sure that he cannot use AC21 to leave the company.

Is it possible for my friend to apply I485 by himself? I have read quite a few times that I485 has nothing to do with the company, and is our document.

If we can apply ourselves, what are the critical documents that we need to have?

Yeah, the company will give him the I140 receipt as soon as they get it. So, that means that he can apply for I485 himself.

----------Yes , he can apply I-485, EAD AP with I-140 pending reciept ,no need of employer letter if he cant get it, USCIS is going to look for employer letter only when they are going to approve the I-485(after 24-30 months) and they may send RFE and you send new employer letter to use AC21 if with same employer then send letter from same employer. if you file I-485, EAD AP no need to inform your employer becase he can revoke the pending I-140 better keep quiet for 6 months after I-485 filing RD, no need to inform your friends. once I-140 is approved AND I-485 pending more than 180 days then employer cannot revoke approved I-140 file I-485, EAD AP and keep quiest for 6 months dont use company lawyer. file directly or file through other lawyer
