I485, EAD, and lay off

Advice, please.

My I-485 ND is Dec 01, 2000.
FP is 4/12/2001.
I have EAD card and AP with my family.
If I get to lay off from my company, what\'s going on?
Do I have to find new H1B sponsor? Or can I get a job with EAD?
How about my GC? Do I have to start again from the first?
Let me know, please.

Once 180 days are over from your ND, your can change job. Its up to you to get new H1 or use your EAD. Your GC process will continue as long as your are working with some employeer.
If you leave country using AOP, you must use EAD when you comeback in the USA.

Make sure that you stay with your company for 180 days after I-485 RD - I spoke to Ron Gotcher today and he confirmed that it\'s RD and not ND that INS considers for 180 days rule. After that, you can join another company as long as you stay in the same type of work. You will be safe - try not to worry to much.

RD is the date INS conferms that they received your application
ND is the date INS sends out Notice to applicant
Usuall a difference of about 15 to 30 days

Lets say that I take 4 weeks to find another job after a layoff in my company. Will I be out of status during that time - or does the fact that I now have a EAD (in addition to the H1) give me some grace period?

Interesting. I keep hearing different views about this 180 day rule. Is there any documentation anywhere that confirms that it is the RD and not the ND ?

Talk to your employer if your i140 petition will be revoked. If not then you don\'t have to worry about. You may start working using your EAD.
