I485 denied: Failure to appear for fingerprinting

Hi All,

I am in bit of a trouble:
My husband got his greencard approved a few months ago and around the same time I had an RFE on my 485 application and I responded to that. It has been a few months now and I got a notice yesterday saying 485 has been denied since I did not appear for fingerprinting. I never received the notice.

To complicate matters, I am currently visiting India and according to the denial notice my advance parole is no longer valid. Also it says that I can have a motion to reopen the case within 30 days and I have already lost around 10 days and I have hit the weekend:-(. Has anybody been through this before? Do you know how long all this process takes to be resolved and what is the process involved?

Also will I be allowed back in the country since my parole is no longer valid? Can I get my fingerprints taken at a consulate in India?

I would suggest cancel your trip. You may have trouble coming back.


Get a motion to restore filed ASAP. This is very common mistake by USCIS so do not worry but get a good attorney and move on.

Thanks so much for your response. But i'm currently in India already. I learnt about the 485 denial after i left the country. Once I request to reopen the case, will i automatically be allowed ot enter the country? Will my advance parole become valid again? What are my other options? Can I go to the local US consulate? Thanks very much.
 
Hi Laxmim,

I am also in similar situation. But I am in US. I filed motion to reopen about 10 days back. Did not hear back from USCIS. Anybody knows how much time does it take to reopen?
