After being a mute visitor to this site for about 3 years I think its time that I shared some info about my case:
EB2-NIW
PD-8/97
RD-3/2/99
ND-3/15/99
RFE-6/25 Emp let., W2, 3recent pay stubs
RFE response Recvd-7/25
Approval-2/8
Needless to say that this site has been of immense help and comfort
to me all along. I would like to thank all the people who take the time and effort to regularly share their experiences to a large anonymous audienceand people like crazyboy who have made a concerted effort to organize theinfo so one can try and make some sense of all of this. I wish everyone all the best and hope their agony will come to an end soon.

Why did INSstill ask employment letter for a NIW case? Is your case self-petition or employer sponsored? Did you send all these documents with your apllication on March, 1999? INS asked these documents due to public charge concern or something else. They should mention this in your REF letter. Could you post it?
Thanks

The RFE was to prove that I will not become a public charge. As
a proof INS wanted me to submit a current employment letter
that stated the salary and prospect of continued employment.
Other evidence included bank statement, W2, and 3 recent pay
stubs. I had submited all these documents at the time I filed
I-485. My case is self sponsored and I have moved from Mass. to
CA since my I-140 approval as I got a better offer. This is of
course a bit risky as there is a possibility that my files could have
been tranferred to CSC-but I was not going to let my career
options be dictated by the INS. Hope this helps.

Thank you for posting, VSC12199. So in your case, you filed I-140 in MA, that means the employment letter for I-140 application is different with the letter you filed with your I-485 application. Are the first letter (March, 99) and REF letter from same employer in CA?
I am in similar situation. NIW, self-petition, moved from east coast to west coast recently. So it looks like INS wants employment letter just for public charge reason. If you have a job in same field, you should be fine. Am I right? Thanks for answering.

No its not. When I moved to CA I had several offers in the
pipeline. The best option came through after I had filed I485 so I
decided to go with that. However I have been with that employer
since then. Also, I was always in the same field even though INS
did not ask me to prove this. So I think as long as you have a job
in the same field you should be fine. Also, they donot care how
many times you change within the same field as long as you can
convince them that you will not become a public charge. But I did
fly to the east coast to get my FP done as I did not want to mess
with the administrative procedures of the INS. Hope this helps.
Best of luck.

Thank you, VS12199. Your posting is very helpful and inspiring. What a nice story. Congratulations!
If it\'s convenient to you, I was wondering if you can sent me the format of employment letter for REF. My I-485 RD is 8/16/99. FP done on early July at east coast. I am expecting approval , but I have to prepare if they send me a REF.
Thank you for helping.
