I485 application: by prior employer

Hello Group,

I need help in clearing up certain doubts. My prior employer had filed for LC/I140 got approved. I left this employer prior to I140 approval, but they continued with the application and are willing to file for I485 based on future employment.

In the I485 application, my lawyer needs me to fill my work experience. Should I mention my current employment? Since my prior employer is the sponsor, I am confused as to whether my current employment needs to be mentioned.

Also, if any RFE arises for paystubs/W2, can I provide those from my current employer?

Please advice. Any advice is appreciated

Should not be a problem...

I think you can mention your current employment should NOT be a problem since your GC application is for future employment. My case was similar to your except that my ex-employer applied for I-140/I-485 at the same time with an approved labor certification. Check out this thread to see my history...

Once your I-485 is pending for 180 days, you can always invoke AC21 if your intention to join your sponsoring employer has changed.

Remember, GC is always for a future job. Please consult a lawyer for an official answer before applying...maybe your ex-employer's law office might be able to help.
