I140 under EB2 - Progressive Experiance

Hi,

I have my LC approved under EB2/RIR recently. I am planning to apply for I140 and I485 concurrently. (LC needed MS or BS+5years of experiance)


I did BE and have the following experiances:
CompA 2 years as Software Engineer
CompB 2 years as Software Enginerr
CompC 1 year as Programmer/Analyst
CompD 6months as Software Engineer


CompE (GC Sponsering company) 2.5 years as Sr. Software Engineer

I gave the experiance letters(CompA to CompD) to my lawyer. Each letter says ... position, period, area that i worked.

My lawyer says that I might get an RFE as i may not qualify for progressive experiance even though I have more than five years of experiance.

Question is:
1. How strict is CSC for these type of details?
2a. Do I have to file I140 in EB2 since I have filed LC in EB2? If not can i file in EB3?
2b. If I go for EB3, Will I have to go to the bottom of the list or just change of catagory to EB3

3. If I file in EB2 and got an RFE, can i go for EB3 if I can't get the revised experiance letter in the following format.

This letter is written in verification of employment of Mr./Ms. X with ABC Limited. Mr./Ms. X was employed full-time by ABC Limited in the position of Database Administrator from Sept 1992 to Sept 1995.

Mr./Ms. X joined ABC limited in 1992 as a junior Database Administrator. Under my supervision he/she was responsible for monitoring Spare Parts Inventory database, creating and managing users, executing monthly MIS reports and taking backups. He/she showed great learning ability and quickly picked up various aspects of Database Administration

In his second year he/she was given independent responsibility to manage and maintain Spare Parts Inventory database. He/she performed database reorganization for this database. He/she was made a part of the/she project team engaged in database design and installation of Finance and Accounts database. His/her role in implementation of Finance and Accounts database was appreciated. He/she also played a significant role in successful migration of Fixed Deposit System from legacy system to an ORACLE database.

In the third and the last year of his/her employment with ABC Limited, Mr./Ms. X was supervising two junior Database Administrators. By now he/she was providing DBA support to two other factories of ABC besides the main factory. He/she was responsible for monitoring performance of all production databases, SQL optimization, planning and managing database growth. One major project undertaken by him/her during this time was design and installation of database for Shares accounting section. He/she also helped in data migration from legacy system to Oracle database for Share Accounting.

Problem here is, I don't know how successfull I will be in getting the experiance letter in this revised format.

Basically, I am thinking of filing I140 with current documentation in EB2 and respond to RFE if i get. If it is too risky, I would not mind filing in EB3 from the begining. What do you recommend?

Priority dates are 7/17 and 3/xx for EB2 and EB3. But my lawyer says it will take around 6-8 months even on EB2. Is this True? If so, How do one calculate correct processing time?

I am in a similar situation.... We'll wait and see. Though i have already applied. I donot know what the outcome would be...

Hi Hello_am,

I got an RFE in LC for RIR related and not for my educational qualifications/experiances. But I have not given any experiance letters to my lawyers during LC stage.

Tell us about your case.

Hi long_wait_4_gc,

How are you saying EB2 and EB3 are current?. As per CSC, EB2 has a priority date of 7/17 where as EB3 has 3/xx.

Hi Raghu,

Well yes I was rfe'd during the LC stage but not for the educational credentials but for the evaluation of the Labor market. Why I asked you was, I heard someone say LC rfed will not result in 140 rfe. however, this is not true. Each stage is handled seperately, of course I know that, but thought that "now" there could be some link ....
