Hi

I received an RFE for my I140 application requesting for company's financial capability to pay.

I have not received a copy of the letter from BCIS. The Lawyer has asked for an array of information. My question is, is BCIS very specific of what it wants or is this array of information the lawyer's interpretation of what BCIS would like to see?

My basic concern being that, could the request for a whole lot of information imply a higher probability of rejection?

RFE could be meant more towards your degree and the salary company pays you. What category you applied and what degree do you have ? Also What's the size of your company ?

I have a post graduate degree from the U.S.

The lawyer is asking for documents regarding the company's finances.

The company has 8 employees including myself. All of them are on a commission basis. The company is doing well and is opening another office.

What do you think????
 
Company's ability to pay is a common RFE

Hi,
I was also in the same situation.I had an RFE on my I-140 on april 29th'03.(It was regarding the company's "ability to pay".)

My attorney as soon as he seen the RFE,he said this is becoming a common RFE now-a-days.And Since my employer did not submit latest tax filings(b'cos i filed my I-140 in jan'03)

WE SUBMITTED THE LATEST TAX returns of the company,etc on may 27th.and got approval in 3 days on may 30th.
So DO NOT WORRY,all will happen....but time taking.

Yippee I got approved. It took just 3 days we replied to the RFE on June 23rd and it was approved today i.e. June 25th. It is simply awesome.
