Hi gurus/Experts,

Any one has any idea if some one gets RFE how long time it takes
for INS to issue RFE , what about if I-140 is pending for a year and person gets RFE after a year and s/he gets EAD before getting I-140 RFE .

does it means EAD of no use.

Please post some details on such cases .

Hi MIB2,

I guess it is unpredictable...so u might not be able to guess when INS can issue a RFE.

ANd you will not get an EAD before ur 140 is approved.(That is my understanding based on some clarification by INS posted on a website)

please let me know if you got a EAD before ur 140 got approved and what are ur RD and ND for 140.

just applied

Thanks parshu,

my lawyer just applied for 485 so i don't know will i be able to get
EAD or 140 first ??

Can u send me the link for INS website u mentioned that INS did
put some clarification on this issue on some website .

Thanks in advance .

If you don't get your EAD within 90 days of I-485 receit date, you can go to the local INS office and get it. I don't know whether it would be valid without I-140 approval? Concurrent filing is very confusing procedure !!!

One can get EAD with out I-140 approval, if I-485 is filed concurrently . But in case I-140 is denied , EAD becomes invalid.

I got my EAD without I140 approval.

I140:
RD: 5/24
ND:5/28
AD:?

I485
RD: 8/29
ND:9/11
EAD AD:10/14
AP AP: 10/13
FP done 10/18

ok thats a good news Then.

My EAD is not approved yet. And I read some article about clarification by INS about concurrent filing. It is also posted in one of the threads on this website. So my impression was based on that news.

Anyways are u sure that ur 140 is not approved. Just curious buddy thats it.

Question for vivian

Hi Vivian ,

Do you have any idea in case of any possible RFE , god forbid not in your case , what will happen to your EAD.

Thanks indian1972.

I hope so. I saw somebody having 7/17 ND with same EB2 case approved. I really worry about my case.

My i-140 online messages says that 'we received your response to our request for evidence or information. It is taking between 90 and 180 days for us to process this kind of case. However, because preliminary processing was complete before we requested the additional material, the remaining processing time for this stage of your case is approximately 180 days. You will receive a written decision on this case' what does it mean?

sneha999,
I am in the same boat. My original I-140 RD = 01/29/2002. RFE date = 04/12/2002, RFE RD = 06/29/2002. AD???
The essence of this story is our application is sitting on some corner ( not assigned to any one).
They say call the INS. My question to any one who says that is. Did you try to call the INS. What a joke. YOU should be GOD if you do not get a busy tone. from 9 to 5 ( which is there working hours).
I wish i had the positive attitude like you do. I will try...

nikreddy,

What is your RFE on i-140. did you apply i-140 with substitute
labour. Any good new about your i-140 approval?
