I140 RFE for employer certifird tax returns

My company got an RFE from VERMONT INS requesting for IRS certified Tax returns of the employer. My employer has contacted IRS and applied for it. It seems it is taking 60 days to get it.

My employer has applied just a couple of weeks back and I have just 25days left for submitting all the supporting documents.

Now I’m really concerned as I just have 25 days left for responding back to INS.

When my employer again contacted IRS they said they can issue Tax Transcripts in a week but not the certified tax return as requested.

Can we submit these transcripts in place of certified tax returns??? How can we ask INS for extension of time for submitting the documents?

Any help will be greatly appreciated. Thanks in advance

I dont think you need certified tax return. I have got a similar query. I have seen my RFE , it asks for 2002 and 2003 tax return.There is nothing that asks for certified tax return. I dont about your case though.

if you think getting certified copy is difficult in specified time limit then why not tax returns? If I were you, I would ask Attorney to send Tax return. If at all BCIS wants certified copy , they would issue another RFE. So you are honoring 90 days RFE limit and also buying time for certified copy. And who knows BCIS officer might be happy with non certified Tax return and approve case. Just a thought!!!

You might want to be careful with that since the release of new Memo regarding RFEs, it clearly states, if the RFE reply does not satisfy the request, adjudicator can use his/her discretion and right away deny I-140 and/or I-485
 
So what we do? We do not have the certified return! But we have enough evidence to prove that it is because of the delay in another goverment organization.
 
The lawyer can reply with in the 90 days period saying that IRS is taking time to give back Certified Tax returns and hence they have non ceritfied Tx returns.

Trust me it all depends on the adjucating Immigration officer. So you might get your 140 approved .

I think Certified copy means certified copy from the CPA not from IRS. You will get transcripts from IRS not certified copies.

I do not know how it works for companies but when I requested from tax transcripts from myself IRS faxed me within minutes and received the copy within 10 days.
