I140 rfe company ability to pay

My company had big loss in both 2002 and 2003. I don't wana submit the tax return as prof of ability to pay for my I 140 filing. Could I send my pay stubs to show that the company did pay as specified in the labor certificate? Anyone had experience on this? Thanx a lot.
 
No Problem to Send Tax Return

The important thing is that company has ability to pay you.

My company has made big loss (last year was 2 millions) ever since its existance. My I-140 was approved. You probably could not avoid to send company tax return. In my case it was requested in the 2nd RFEs.
 
You have to submit all papers you are asked for regardless of your feelings towards submitting them. I wouldn't worry too much about your company status. Green card is for future employment not current. And using AC21 you can always change your job 180 days post 485 application and 140 approval.

I guess I might over reacted to some people's opinion that if your company had bad tax return then you will get into trouble with the "company's ability to pay" requirement for I-140. Actually it was my lawyer's idea not to sent the tax return. So based on what your guy said, I will most likely get a RFE. Filed I140 with I485 concurrently in Sep/2003. Got AP and EAD in Oct/2003. Still waiting for I140.
