I140 questions for future employment

hello Gurus

In I140 stage , does company's ability to pay beneficiary, depend on labor filing date in case of future employment.

what are the important things to look at when I140 is applied for future employment.


In case of future employment, can AC21 protability be used in case LC is approved and I140 pending from future employer.


Please advice.

A> Yes. Company's ability to pay should be established since the day of labor filing date (priority date). If the company has more than 100 employees, this may not be an issue. If the company has less than 100 employees, the comapny has to establish the ability to pay since the priority date.
