I140 Pending since May 2002. contact senator

Hi All,

My I140 case is pending since May 2002. (EB3). My 485 filed in sept. 2002
Talked to local senator and tried to trace my case.
Senator office received a reply from Vermont center saying my I140 and I485 cases are merged together. And I should receive something until in April/may 2004.
Should I laugh or CRY on this Vermont reply ?
 
waiting4140. You should just laugh and move on. I recommend to you something. Run the script availble on this forum and see the fate of other 140 apps around your that might give you some hint.


I run mine and found out that 10 app after me and 3 app before me. 10months ago but then there were other around it that are pending. I am going to publish an extensive ND Nov-Dec 02 study soon.

It sounds like you are on an I-485 schedule and no longer on an I-140. I am also a May 2002 languishing concurrent petitioner. My I-485 was received on Nov. 19th, 2002. I guess the decision would be done on the whole package. Last Summer, an officer told me that it will take 20 months to get an interview, i.e., sometimes before Summer of 2004.
I inquired recently and the officer sounded like they were talking more about the I-140 schedule than anything else.
I was hoping to hear these days about my I-140 (May, 31st,2002) but based on what you are saying, I might have to bury myself for the next 6 months before I emerge again.

If this is the case for semi-concurrent

based on above postings, I feel that for semi-concurrent filing ( I mean filing i-140 first and later filing i-485 while 140 is pending) I-140 will be processed based on I-485 receipt date. Am I correct ?

I filed my I140 in April 2003 and I-485 in Oct 2003. If the VSC process pending I140s based on I-485 Notice dates, that's it I have to wait another 1year for my I-140...Its kinda pain to hear that..

Please post your views.

You cannot say any thing with USCIS. There is no policy on the approvals of I-140. Every month it is different. There are so many people on this forum that got the approval with all kind of filing. I am also a 'Semi concurrent' filer. I know at least 5 guys who got their approvals like this.
There is no logic about what they say and what they do. Just wait nothing else. They will be feeding such crap to the people.
Name USCIS should be changed to USSR. Bureaucracy in USCIS is worst then Soviet Union.

Don't take that reply seriously. VSC will invent new reasons to justify their random-processing. Lot of applicants who have filed the 140 and 485 (semi-concurrently) got their approvals....
Unlucky souls like you and me (140 RD June 2002) are waiting for ever!!! Someday, the approval will happen.. When I contacted VSC (before the formation of NSC) through a Congressman, i was told that i can switch companies anytime since 140 and 485 are filed together.... But, i suspect that if the employer specifies that both should be processed together, they honor that request! I DON'T HAVE GOOD OPINION ON MY EMPLOYER!

And not a truth.

But we can only hope.

If VSC starts honoring such requests.
May GOD save us.

Employers may also start putting request like
Don't process this application until I instruct to do so.

What a joke. Why r we still pursuing this:confused: :rolleyes:

I SINCERELY HOPE THEY DON'T DO THAT.

I WONDER WHY I-140 RANDOMNESS IS THERE ONLY AT VSC AND NOT AT ANY OTHER SERVICE CENTERS?
