so what is going on?

First of all, thanks for starting this new thread which is more pertinent to folks who are now waiting for I485 approval alone.

Now, what do you all think is going on with the delay in processing our applications?

1) I noticed that 4 out of 11 people here have applied on EB3 basis. Is this a reason why our applications have not been approved simultaneously with the approval of I140? (I am assuming that those who have had simultaneous approvals are not EB3). Are you all planning to call the customer service number to make an inquiry?

2) I was of the impression that concurrent filing of I140 and I485 meant that the applications are judged together too. Is this right? If my impression is true, then is the delay just administrative delay?

3) Does your online status show that your I140 has been approved? In my case my lawyer got the approval letter. I do not understand why the records are not updated.

Hope this starts an educative discussion.

LUD with no message update, solaris funguru pls share your experince

hello,

I saw an LUD on my 140 no message change . Mine is a SUb labor. So i am curious to know since some of you guys had sub labor too. Did you guys have LUD with no message too. What happened next ?

An LUD (with no message change) probably means that they processed your case, either approved it or issued an RFE. In my case it was an approval.. and they sent the approval letter to my lawyer, who inturn told me about it.
Now, since I140 is still company's property, the lawyers will not share the approval notice with me... at least until the next 6 months when it becomes mine even if the 485 is still pending. ( I think this is most probably my company's policy ).
Its sad that the online case status update has now become irrelevant.

People who have applied in Feb 05 are also getting 485 approved, why are we stuck? :mad:

There are whole bunch of people got stuck in I-1485 after I-140 approval back to 2003. Read the I-485 threads, I bet you are stuck in FBI name checking. Those who got I-485 approval are very small percentage.

Lets hope that we do not get stuck in the name check process for too long, I think from this point on it is almost impossible to predict "Approval", anyway waiting for next JIT report so I can call CIS for 485 status.
