I140 denied. Labor filed.

My I140 has been denied and petition was filed using other employee labor. Recently I came to know that my company had filed my labor as well when they filed for I140. I was not aware of it.

Can company file my labor without I know about it?

Secondly, asking the reason of I140 denial, lawyer says it happened because rule has been changed in early 2004. My petition was filed in mid 2003. I believe new rules do not go in reverse, but onwards from the date it’s implemented. Am I wrong here?

Ask your attorney what rules he/she is referring to?? also the actual reason for denial. Your attorney would have received the denail notice. And did you file 485 also and if so, did you get EAD/AP and FP'd. If so, Did you (as applicant) get denial notices on the 485, EAD, AP??
