I140 Approved

Hi, I am new here. I just submitted I-140 based on EB1-EA to TSC. Here is my criteria: USA Ph.D working in biomedical field; have 4 papers and 27 citations; 8 ref letters; participate in writing a book (one chapter); got a American Heart Association grant and a few national and local awards; reviewd a grant and two papers before. Please let me know what you think of my case (weak, strong?). Should I go PP?

All depends on how good your lawyer or employer is at filing. They make so many mistakes that if you are not on top of your case you may run into issues. I made sure they sent me all my paperwork before sending out and still I discovered so many mistakes and that's the only way I was able to avoid RFEs and so forth.

Do I-140 processing times depend on whether the case was TR, RIR or PERM? Do they depend on the LC PD?

MY EB2 TR LC has a PD of June 2003. I just received the AI so I'm predicting if all goes well that my LC might be approved sometime in June this year. Then we'll either file for I-140 or concurrent.

From reading the posts above for TSC, it seems that regular processing takes 1-2 months in most cases, while Premium Processing takes 10-14 days. But it seems that most of you guys are PERMs and RIRs. Does it make a difference? The lawyer is telling me 6-8 months!!! I hope he's wrong since maybe most cases are 1 month or so.

Please see the trackitt forum for I-140 processing timeline. Filter data by TSC, EB2, Regular processing, Status = Approved, sort by approval date (descending). You will notice that approval times nears 100 days - if an RFE issued, this may go well beyond 130 days. I don't think your LC type (PERM, RIR or Regular) matter. There were some speedy sporadic approvals (around the end of 2006) but you cannot count on them. Also remember that the BECs increased the approval rate since December 2006. Therefore it is possible that the I-140 processing may take longer in the coming months.

Concurrent Filing

Gurus,
I just received my Labor approval and my PD is Aug 2001 , can I file for both I-140 and 485 ?
If not is there a premium processing for I-140?
I look forward to hear from you guys.

It depends on which country you are from and your labor EB2 or EB3?
If you are from non retrogressed country you can apply for concurrent processing.. Give more details..
There is a premium processing for I -140
 
hi manwithnoname - nice to see you here in the 140 forums, missed you for a month in the backlog forums before my labor was approved in a weeks time after urs - i got delayed in applying for my 140 though... mine has a receipt date of April 18 and its in the Texas service center.. are you maintaining any tracker here... i am reading that Texas has the quickest times in these forums... is that accurate...

Hi - My Premium processed I-140 was approved on 4/24/2007 by TSC. How long does it take to get the actual approval notice in mail?

I-140 approved

I filed my I-140 in January(Received date - Jan 3rd 2007) and received the approval notice. I saw LUD as 07/18/2007 but did not received any email despite turning the "Email ON". Online status still, even today, says "Case received and Pending". I filed my I-140 myself as I could not forgive the lawyer for her mistakes during the LC filing. My PD is May 19th 2004. I am also filing my I-485 myself.
 
I140 Approvals Recently

HAVE FILED MY I140 at Texas Service Center on January 2nd. The received date is 01/04/07 and the LUD is 01/08/07. It says "Received and Pending" still. I haven't got any RFE or anything till now. I don't know why the delay.
I am keeping my fingers crossed. Its almost 7 months now. :mad:
