Applied first EAD with my I140 & I485 - Got approved in July 2003.

Applied for first AP in OCT 2003 on my own. (RD - 10/10/03) -
Not yet approved - Have to travel to India in May 2004.

EAD renewal - Not yet. Will be doing it end of this month.

H1B expired in Jan 2004. Employer Applied for extension in OCT 2003. Not yet approved.


Small consulting Company - don't know the head count.

I think your AP triggered immigration officer to take a look at I140. Your company's financial for 2002 and 2003 were on positive side so no RFEs (irrespective of company size).

Like you, my H1 extension with ND Oct 8th is still pending.

I am trying get the officer's logic and apply to my case.

Was your company at loss in any of 2002 or 2003?

I wish they approve my AP too.


I think my company financials must have been good for 2002 and 2003 and years befor that. I don't know the numbers.


Anyway I am happy that my I140 got approved .
 
HI sukal and rajudm, I need a clarification. I can see that both of you have EAD, but still trying to get 7th year H1 extension. Is there a reason not to use EAD?

EAD usage

EAD usage is not preferable when I140 is still pending. If there is a chance to keep H1 status it is always better. If something goes wrong and I485 is denied then one would get a very short notice to leave the country.

I have another 2 and half years left for (6 years cap), so H1 extension is desirable.
