Dear Friends,

My I140 is approved an year ago. Waiting to file I485 as usual. I've my 3 yrs H1 extenstion approved upto 2010. Now can I switch my employer? What will happend to my GC process? Can I carry my labor, I-140 and priority date Aug2002 with me?

Thanks in Advance.

An article from another immigration website:

Changing jobs after approval of an I-140 where an I-485 has not been filed means that the green card case will have to start over, right from the labor certification (LC) stage in LC cases. However, it is possible to request to retain the priority date in a later I-140 petition, once there is an approved I-140 petition in an earlier case with a different employer or even for a different position with the same employer

Has any one done this before?

Thanks.

Yes , you can carry over your old priority date while fining your I 485 with new company
