My I140 just got approved. However, the approval letter says I'm not eligible for adjustment of status and my approved petition has been sent to the National Visa Center (NVC) in New Hampshire. The NVC then will send me to the appropriate consulate to get my H1 visa stamp.
All this is because when I filed I140, my H1 was expiring and I was applying for a renewal. When my I140 was processed, my old H1 has expired. Although my renewal has been approved. They think I am not in valid visa status.
My lawyer will write a letter to VSC along with my H1 renewal approval letter, etc.
Does anyone here has the same experience? What did you do to fix the problem? Is my lawyers letter enough?
