I140 Approval - Do you want to know when your application gets approved ?

Looks like NSC is approving cases based on Labor Condition application priority date (when your labor filed).

I feel, just Aug/Sep filers of I140 update this thread with LC priority date including I140 ND/RD date.

My detail:

LC applied date: May 2003
I140 RD/ND date : Sep 30 2003
Approval: waiting

I do see, "dasarihp_newid" LC Priority date is Feb,2003, and got approval recently.
 
Priority Date 02/22/2003

My Priority Date (I believe this is the date when labor is filed) is 02/22/2003. EB3/RIR

I140 ND 09/10/2003.
I485 ND 10/06/2003.
EDA/AP approved.

w/f I-140 approval.

Could you please help me out to see when can I expect my I-140. My client is willing me to absorb but I haven't got my 140 cleared. I have another 5 weeks left in the current job. After that my employer would pressurize me to go to another place...please advise. I am also going to have a baby soon..so it will be hard for me to move...

I have seen one case who applied LC during June 2002, and I140 got approved recently. I think the user name is "dilbert" , infact "dilbert" filed I40 during Jan 2004 only. Hope your application will get approved soon.

As per the November 2003 UCIS note clearly explains that they process case based on Priority Date of LC for all EB* cases.

But according to this portal site thread, based on their individual experience no one is agreeing that UCIS is processing in a consistent method.

If you get lucky 4-5 months from ND
Normal Range 5-8 months from ND

Hi lc2003, GMuthu,

Thats correct. My priority date is June 2002. Labor approved in end of Dec 03. I 140 filed around 23rd Jan and approved in March. You will find a part of my details (until RD) under the name dilbert in the Excel spreadsheet, but you will find all the dates under the name "dilbert30" (which is my login) in the excel spread sheet.

I read somewhere in this forum (?) that i 140 cases might be processed according to labor application date.

Mine is eb2 / rir/ cp. Good luck to you - GMuthu.

Based on labor priority date can anyone guess when should I be hearing about my I140.

I don't think the priority date is criteria

My Priority date is Feb 2003 and it is approved two days back. I am sure most of the I-140 filers during 2003 have the Priority Date in 2003 and most of them got approved.

Yours Priority date is 2002, so it should have been approved. I believe, your ND dates are also important.
 
As you can see from nemo's case, it is not based on labor priority date..

before last 3-4 months the approvals were getting done smoothly, like these approvals were coming after 4-5 months of applying..

for last 3-4 months as I can see, the approvals were mainly limited to those who file in EB1 and EB2 in mainly CP and AOS. and also some EB3 CP, these were approved almost till march of this year. and the cases for july/aug/sept in EB3 AOS were stalled or very very limited and random.

Then since last 2-3 weeks, they started going mainly after EB3 AOS applicants who are huge in numbers and you can see their approvals coming up now for the Aug/Sept filers including mine..

This can be seen from the approvals in the tracker too..

Currently if they continue this way, I can say that all the EB3 applicants can see thier approvals in 6-7 months from the date of applying..

This my opinion.
 
I am completely agree with Sanvibha and dasarihp_newid. Priority Case got nothing with the I-140 processing.

Lot of people with Priority date of 2002, are still waiting(including me).

I guess, the only reason why the cases filed after September 2003 are getting approved faster is that USCIS changed the I-140 form in October 2003 and when they got lot of new officers, they trained them to handle the new form, not the old form filed till Sept 30, 2003.

Looks like yours is EB3, ND June 19, 2003 and Non-Concurrent. What is the current status of your case?

how long does it take to clear labor in IA ? am in MI - it takes 18 months as of now, and our I-140's are getting approved in 2 months bcos of that
