Hi Guys,

I received email just this Friday, Feb. 23, 2007 that my I140 and I485 has been approved. Now my question is on what would I need to file for my wife and child who are H1B and H4 Visa holders respectively that just arrived a month ago.
Is it true that the only way for them is consular processing? Meaning they have to file thru the consulate in our home country?

Congrats!

Did you have any LUDs on your I-140 and I-485 after the FP's?

nope, i didn't have any LUD's after my FP's ... i was actually surprised that it only took around 3 months for my I 140 and I 485 approval.
anyway, could you suggest how i could file for my wife and child ? do they really need to do consular processing ? or could they just do an AOS while here ?

I'll add my 2 cents, although I claim no immigration knowledge as I am a newbie here, but I applied for my spouse at the same time as me, not sure why you applied alone to begin with

thanks :)

sorry for the confusion :) ... my wife already had a pending H1B application so she was waiting for approval in our home country, while i was on a business trip here i got lucky and found an employer who was willing to sponsor me ... so they advised me to just file alone first as my wife had a pending H1B application.

I think, the best way for her to go about it is filing her own Employment based green card and claiming your kid as a dependent on her I140/I485 process. As far as claiming as a dependent on your already approved case is concerned, she has to go through the Family based; I think that would take much more time than her EB based Green card.

Check with a competent lawyer!
