I140 and 485 Premium Processing!

I was in your position once. I was unable to get my company to file for my I485. In my case, lawyer is the once who went against me. Company\'s CFO was willing to provide everything I might need to file for I-485. So what I think is if your company lawyer don\'t want to file for your I-485, get another lawyer. There are tons of good ones out there. Explain your situation to your boss or HR or even higher ups who are nice to you and convince them to provide all the supporting documents. Since you will be working for the same company you have better chance to get this done.

If you have to do it all over again, LC alone might take 1-2 years. So seriously think about it and get some good advice. I am not sure how this will be done, but I think it is possible for them to apply for I-485.

I am changing locations(different state) within the same company, becuase my original branch is closing. The lawyers say, they have to restart the whole GC process. IS it true what they are saying, or telling me stories.?
What points can i argue to let them file my I-485( i have I-140 approved on March 1st).
Now they say they have to restart the whole process again when i move to my new branch.

If she transfers to Atlanta, she would need to start the green card process all over again, including getting an H-1B amendment.

It might be possible for her to use a labor certificate that has already been approved but not used for a Software Engineer.

What about I-140? can mine be reused.

I don\'t know the whole case but Transfer shouldn\'t effect GC.You can file 485 without any problem....

If the job location moves, the LC becomes invalid and the process needs to be restarted. To get around this, many companys who file for employees whose job location may change use the location of the corporate headquarters (not the state of incorporation, being incorporated in Delaware (most large US companys are since Delaware\'s corporate law is favorable to corporations and has been well established) doesn\'t mean that the corporation can file for an LC in Delaware). Using the corporate headquarters "and other unanticipated locations throughout the United States" permits the LC to remain valid even when the work location changes. Of course, a change of the corporate headquarters outside the metropolitan area will also invalidate the LCs filed for that location.

Again, without seeing the LC and knowing all the circumstances, it\'s not possible to say more.

No I-140 can\'t be reused.

They have to re-file for your I-140. But you have to consider your self very lucky if they have any unused LC\'s for you to use. Meantime, if they start Premium Processing for I-140, you will be in 485 stage in no time.

If your company don\'t apply for your 485 atleast try for LC substituation at your new location. It will save you lot of time.

- For the INS re-org did it ever mention how to improve its service, I doubt it; if only they could work 10% as efficient as IRS on my tax returns...

INS Institutes New Security Checks

INS has stated that all pending and future petitions and applications, except N-400s, are being subjected to a new security check. The INS is unable to tell us at this time to what degree this process is expected to delay adjudications. The Service has informed us that it will not be implementing premium processing for I-140 petitions at this time, but added that the existing premium processing program will not be delayed by these new security checks unless there is a security "hit." The INS will continue to keep AILA informed as more information becomes available.
 
passport issue, and savings

My nephew\'s wife lost her passport, and now has her greencard.
She said immigration told her since she was married to a us citizen, (I too am a us citizen) sponsoring my new husband who I currently live with in the states. First of all, she says immigration said for me to file for his greencard, I don\'t have to have his passport, for it was stolen, and he has a police report.
Also do I need to have a savings, if I have an investment property listed in my assets?

Changing Employers after 180 days

I filed my 485 with a company and am working at a client site. My client is putting pressures on me to join his company.

Is it okay if I change my employer after 180 days? The job title, salary and job description is the same and so is the geographical location. Will the INS raise any objections to this?

They might but the RFE should not pose a problem as long as you provide the information

There are still no implementing regulations for AC21, so we don\'t know exactly what it means. But, I don\'t see how AC21 would have any meaning at all if it did not cover your situation.

We all had become curious as to when (and if) the INS would implement premium processing service for employment-based permanent residency (I-140) petitions. Originally, the INS had anticipated that this would become possible in the Spring of 2002.

The latest news is still hopeful for this expedited service becoming available; however, not as soon as we had originally hoped. In a recent teleconference, Lorenzo learned that the expected date of implementation is not until at least June or thereafter.
 
anyone get 1 485 receipt recently from california center?

i sent out 485 at 5/02, no receipt yet, is it very slow now?
 
what is the 180 days rule?

I filed 485 recently, but i am afraid the company will lay off soon, i heard there is a 180 days rule, if i got laid off in 180 days, what will happen? i am in california
