I need your suggestion on my case.
My I140 was filed under EB3 instead of EB2 as my labor is for EB2. It was a mistake and informed to my attorney before the approval. But, the attorney mentioned that we have sent a letter, no need to worry. Finally the outcome is USCIS did not taken the correction and approved my I140 with EB3. My I140 approved in 2003.
To correct this situation, need to make an amendment. Due to federal id change, my employer must need to inform the Federal id to make the correction. So the correction must be for i) EB3 correction ii)Employer Federal id change.
Will there be any problem to file my I140 amendment? Assume that, if my I140 amendment get denied, can I use the old 140 approval or will there be any issue with my pending I485? Please advise.
