I just got my LC approval 2 months ago, but now facing a problem with my I140 petition because of company ability to pay.
I work as a software eng. in a startup company (6yrs) w/ employees<100.
The company is still losing money but our business prospect is very bright.
Our orders has increased dramatically since the last 2 yrs and we will break even by the end of this year.
Since the last 1 yr, my salary is higher than prevailing wages, but it's lower than prevailing wages when the first time I applied for LC.
My lawyer asked the company to provide tax returns, but since it's a startup company, the report is still minus.
I have renewed my H1b twice for the same company and my h1b will expire in Nov.2007.
Could someone please give any suggestions?
How is my chance to get I140 approval?
Do you think moving to another company can solve the issue?
