Please see my signature for more details. Just receice email today saying 140 and 485 were transfered to local office in Vermont and i live in NYC. My 140 was origianlly denied due to ability to pay issue which i then filed an appeal. Now both are transfered. Does this mean my appealed was granted? Does anyone know? please help.

According to your LUD, Yes, mostly your appeal should be granted. If I-140 is denied, there is no LUD for I-485. You may receive REF for I-485 and approval notice in weeks. Anyway, I think your LUDs show positive sign.

thank you for your response. this totally baffles me. 140 message status remained the same which says that case was transferred to AAO, but the LUD changed. and 485 message/lud changed with new message saying case was transferred.

Don't worry! I was in the same boat. I got my I-140/485 denied 12/30/04 due to ATP and files appeals twice. USCIS noticed me my case was transfered to AAO on 05/2006. Three months later I received RFE for I-485 on 08/2006 and received I-140 approval notice on 09/2006. If you get full pay when you filed appeal, the I-140 should be granted. Don't expect USCIS to place any latest update to your case status screen.

What RFE did you have to submit for 485? and i am not getting full pay when i appealed, because employer refjuses to fully pay me until approval.
