I140/1485 concurrent filing?

Hi,

I have a question regarding to I140/1485 concurrent filing? Does it apply to any cases or just particular ones? How does it actually work?

I have B.S degree and I am aware that the visa number is not current for the EB3 category. I asked my lawyer and he said I could file them both together. Apparently, my I485 was sent back to me with the explanation of why it was returned. I can not file the Travel Document until I file I-485, can I? and when my I-140 gets approval, can I send my I485 application even thought the visa number is not current?

Please help. I am confused and frustrated because my lawyer is not honest.

You will be eligible to file I485 once your priority date is current.
DO NOT FILE BEFORE PRIORITY DATE IS CURRENT. SAVE YOUR MONEY.

How can I know my priority date? Is that stated when my I-140 is approved?

Definitely, I will change the lawyer, but I have to be careful because he might do something with my case.

Just one to clarify.

if my LC was file in Decemeber 2005, and my LC was approval on January 2006, my PD is in December 2005?
