I130 Interview on 8/4 (1 year after filing)

I am hoping that I could get some (positive) advise from some people that might have already gone through this.

I filed the I130 petition for my husband last July after he'd been picked up by ICE and placed in detention for close to a month. Our I130 is still pending but we've already had 3 MH. Have one scheduled for September and we've already been to 2
appointments through infopass to see if we could get updated.
On the last infopass appointment, the officer told us he would be putting our case at a supervisor's desk (whether or not
that's true, that's exactly what we were told). We received an update today that the case was at a USCIS processing center and it made me realize that we should start really preparing for the interview because if we get nervous or intimidated we might get confused and might end up having different answers..who knows.

I have a very important question to ask. My husband was unemployed (due to his lack of status) for a long time but has recently hired at a job and has been working (illegally) for a couple of months. I am sure we will be asked whether he has a job and we do not intend to lie about it, but what consequences can that bring forth? how do we handle this question properly and how do we explain the desperate financial need we've had? can this adversely impact our case?
he does have a SS number (which he was given the first time he filed the I130 from his previous marriage to a USC which ended right before their interview).

Your post is familiar. You have posted others before (I looked but did not re-read them). You have left out some information this time.

He was arrested at least twice.

The timeline you have posted here indicates that you married BEFORE he was placed in proceedings with a 1st master hearing in 8/2010, but in your write-up it indicates three hearings. There appears to be some discrepency, please clarify.

Also, there is not enough detail about his 1st marriage to a USC and the actual outcome. Generally, one is told to depart and if they don't an NTA will be issued. Often a person in that situation may try to fly below the DHS radar, not provide a new address and not get the NTA (on purpose or not, it makes little difference).

You may very well be in love and have a great marriage BUT if his prior marriage has been labeled as fraud it makes no difference because the current I-130 could not be legally approved.

Add more details and perhaps you will get more useful information in response.
 
yes, i told my story on previous posts before.

husband was arrested once only for driving with expired license last july 5th. he's never had any other issues with the law not even a parking ticket.

he met his previous usc spouse in 2002. they got married in 2003 and waited 2 1/2 years before they file the petitions. their marriage was real. but soon after filing all their paperwork, things started falling out between them and by the time they got the interview notice, they didnt want "pretend" and she refuse to go. his application was denied in 2006 but no further action took place. he did receive his work permit and id and all (which he had gotten before the interview when he filed for his i485). he remained illegal and in June of last year we got married and planned on filing a new petition. but unfortunately while waiting for our marriage certificate, he got caught driving and placed on an immigration hold.
a couple of weeks after this, i filed the i130.

he got bonded out a month later and we have been to 2 master hearings with no updates. We were supposed to go to a third master hearinga few days ago, but i think because we made an appointment to speak to an officer and explained we didnt want to go to yet another MH w/o an update, our court date got postponed for September.

We just got a letter that we have the interview on 8/4. I need to know what are the consequences of him admitting he has a job right now.

I hope this helps in clarifying some questions you had.

The whole thing took 10 minutes from beginning to end. The officer looked at my wedding album but was not interested in looking at any other albums or documentation other than lease, bank account info.
She said everything looked perfect after she asked me ow we met and if we lived together prior to getting married.
YAY! now we file a motion to terminate removal proceedings.
