My I-130 petition for my wife got stuck at security check and do not believe it will get approved anytime soon. Need to travel in summer 2006. Any advice on the best option will be appreciated.
Here is my situation.
1). Filed I-130 for my wife in 2002 as a permanent resident.
2). I became a citizen in 8/05 and upgraded my I-130 petition in 8/05.
3). The I-130 case got transferred from NSC to CSC in the name of speedy process in 10/05.
4). I filed I-485 in 11/05 with a RD 12/05 (I-130 was still pending but I filed I-485 anyway.)
5). Called the 800 number for the I-130 status in early 12/05. I was told that the case is pending due to a security check.
My wife has been maintaining a F-1 status since 2001 when she first entered the U.S. She is currently in the U.S. as a full-time student.
My wife and I need to travel in summer 2006. What is the best option for us? As far as I know, I can either
1) apply for an advanced parol (I-131), or
2) apply for a K-3 visa, or
3) both of the above
so that she can legally return to the U.S. while I-130 and I-485 are still pending. Is there any other option? Thank you for your time.
