I130 Approved - Now What?

Hi,

I have a question on behalf of my cousin. Her father (US citizen) filed I130 petition for her (Category : Married Sons or Daughters of US Citizens).

The priority date is July 2002. It got apprved a week ago (Vermont Service Center).

Now what is her next step? Does she just wait now for her priority date to become current to file for I485? How long is the wait? She is now in the USA on H4 status. or, can she file I485 now based on I130 approval? :confused:

I would greatly appreciate your thoughts/inputs.

She has to wait till her priority date becomes current , before she can apply for AOS or CP. Right now the priority dates , that are current is 15 Mar 1998 and I would presume that she is not from Mexico or Philipines as for them the priority dates are @ 1990. Hi,

This is in relation to my previous thread regarding my cousin sister's approved I130 petition. Well, she showed me the approval notice. It says in one place that "The information submitted with the petition shows that the person for whom you are petitioning is not eligible to file an adjustment of status application at this time"

Does it mean her priority date is not current yet or they are talking about something else? Please note she has been in status all the time.

Any input would be greatly appreciated.

I130 Approved - Interesting Situation Now

Hi,

This is me again inrelation to my cousin sisters petition who got her I130 approved recently based on her father's application (Category : married sons or daughters of US citizens, Priority : July 2002, Chargeability : Worldwide). When I was explaining to my uncle and sister about their next step, my uncle mentioned to me that when he got his family based immigration, her daughter had initially been included as dependent, but, when the application got approved, she was already above 21 and he did not pursue her case neither did cancel the application.

I guess my question is, can my sister now somehow take advantage of the newly introduced "age-out" rule?

Do you guys think my uncle or sister need to consult an attorney in this regard? Did any of you go thru same kind of experience? Any ideas how to approach this?
