I am not yet clear on one thing - supporting documents - what to send?
For initial EAD for pending I-485 applicants - (c)(9) it is required to send:
1. 2 photographs - they will take her FP and digital photo at ASC.
2. a copy of white card - both sides (if any)
3. a proof of pending I-485
I think for renewal you should also send them a copy of his EAD.
What I don't know is if showing the white card and the proof of pending I-485 to the officer at ASC would be enough or they still need to be sent.
Thanks Anhit for the info. I will file for EAD probably tomorrow. I been reading FBI Name Check thread in Citizenship thread since morning. I am not ready to spend so much money on which they will have to give me eventually. i will see if I can do it by myself. i still have 4 months though.

I know America is a great country but it is difficult to understand why it takes so long for them to do Name Check? How can we trust them for our protection? Anyway Thanks for your encouraging word.
Some how this all doesn't affect my husband's sleep. He was asleep and snoring at 10 p.m. yesterday night and I was up till 12.30 a.m. :rolleyes:

I am very sorry to hear about your case. On a lighter note, your husband and I are the same. I don't stress much about my immigration status whereas my wife stays up all night long trying to figure out our future status in this country and god knows what else (remember...I am snoring while she is thinking all this).

I hope this put a smile on your face. If not, SMILE. Don't stress. You have helped a lot of people and you are a confident woman. I know that if you put your mind in getting something done, you will get it done or atleast find out the best way to do it. So...sit back...relax, take a deep breath and start over with finiding out how to expedite the name check experience. I hope and pray that we all get clear soon.

Thanks EricneesGC. It did make me smile. I am ok now. My first priority will be to not get myself stressed on this matter which will make our life miserable. I discussed about this with my husband yesterday. Which is more important for us rightnow? Our happy and peaceful marriage years that are going on or the GC? We decided on our life because the years that are passing by will not come back. And I know they have to give him a GC, if not today then after 3 years.
I am going to take steps from my side and stay on top of my case except filing a lawsuit. Because that gonna affect badly to our lives.
Have a question. Is it risky for him to travel using AP or not?? We were thinking of going to Canada to visit our friends. Is it ok for him?

Its not risky to travel on AP as long as you have all your documents with you. Although they require a valid passport and AP but its a good idea to keep a copy of your receipts and USCIS letters handy.

Personally, I am trying to avoid all travel outside the US. The only thing that depresses me is that my wife wants to go back on the same cruise we took for our honeymoon to celebrate our 5 year anniversary. The low risk taker I am, I will probably try to avoid the cruise if possible.
 
My Visit to DO

Some of you may remeber me and my case. Here is the update on my case. Actually there is no update but just want to share info.
We went for my husbands FP appointment on Tuesday. I also took infopass so I can ask about our case. The officer at window said, our interviewer officer has apporved our case on 31st of Jan and our case is waiting on FBI name check to be clear which was initiated on 22nd April, 2005. The interesting part is, she said they resubmit the name every year so that if the packet was dropped at first time or the name was spelled wrong at first time, it can be corrected at 2nd time. This is good news. Now there is a 5% hope that it can be cleared 2nd time. Will see.
Also since officer has approved our case, I think my husband's criminal case is all setteled.
 
Do not feel sad...at leaset your husband is with you not like many others who have been separated from their loved ones becuse of name check and INS BS.

You husband has options: after 120 days from the interview he can sue INS in a district court. read on this subjiect in the US Citizenship folder. Good luck.

Thanks for your encouragement. 120 days rule is for Citizenship only and not for GC. I am closly watching the Name Check thread in Citizenship forum.

I am confused about one thing, though. How did they say that they initiated the name check in Apr'05, when your husband's FP was done only in May'05 (from your signature). I was under the impression (and as told by an officer) that the Background check starts prior to FP, but Name check is after FP. Any idea?

That is what I was wondering about. But I have read on this forum that FP has nothing to do with Name Check. The officer gave me specific date for Name Check so I guess she was right.
