I really need some advice w/ I-751

Hello guys, I come here for some honest advice. Here is my situation; back in August of 2007 I got my conditional green card based on marriage to a USC. My wife and I have been married for about a year now. In January of 08 she sat me down and basically explained to me that things were not working out due to us being so different. I tried to change her mind but she thinks that the marriage is beyond saving. In the middle of January she moved out and got her own place.

When she left she told me she wanted us to be friends and be in good terms because she knows I am a good guy. Well, she called be a couple of days ago and said that she wanted to file for divorce but only if my situation with USCIS wouldn’t get affected to the point were I would be in trouble. We still care for each other and I know she honestly wants to help me out.

But here is my situation. I know she wants to help me out but I feel bad staying married if I know things are not going to work out. I feel like she feels like she’s stuck with me until this is over and I honestly don’t want to put her through this.

My question is, should I file for divorce and file the 751 and the waiver with USCIS or should I stay married (but obviously separated) and wait till I get my perm green card?

What are my chances of getting this approved? For supporting documents I have, tons of pictures, health insurance together, joint bank account statements, joint motorcycle loan, motorcycle insurance in both our names, old lease from when we got married and moved in together and joint 2007 tax returns.

Can you guys please give me some advice? I honestly don’t want to feel like a burden to her because she is a sweet women and I know its tuff for her to have to keep this going for INS reasons.

File for divorce. As soon as it is finalised, file your I-751.
