I petitioned for mom's GC years ago. Doing one for wife now. In a strange situation.

I'm a USC. When I turned 21 eight years ago, I filed for my mother's GC and it got approved with no problem. Of course my name went on her I-864 as her sponsor. We also used my uncle as our joint sponsor due to me and my mom's low incomes, at that time.

So now I'm married to an F1 student and in the process of applying GC for my her. We are both full time college students with 0 income, living at my mother's house. Because of this, I am using my mom's income to satisfy the poverty requirement in my wife's I-864.

I'm working on question B of I-864 on Page 2, specifically where it says, "List persons below who are included in lines 1 or 3 for whom you previously have submitted INS Form I-864, if your support obligation has not yet terminated."

In short, the thing that got me concerned is the fact that my obligatin as a sponsor to my mother is still in effect, and now I am using her income to satisfy my wife's sponsorship requirement. (keep in mind that my uncle is my mother's joint sponsor) :confused:

Are there any issues I should be concerned?

I may be over reacting here, but I would rather be safe than sorry.
 
I believe that you are fine as long as you have more than 125% of poverty level income to support all these people according to your sponsorship. It is definitely good to have significantly more income :). But this is just to verify that you have the means to support this new person that is coming into the country as your sponsored.
 
In that question since you are living with your mother, then you must include her, the 125% over poverty level will be higher than when you apply for her since there are more people in the household.

As long as you mom's income is above 125% poverty line for a family of 3 people (assuming is just you, her and you wife) you're OK.

but isnt it supposed to be for 3 years??? like 3 yrs above 125%...need a answer coz my roomate is in same situation and i want to help him out...

my income is almost 400 times,but i heard its for 3 yrs right? also i am planning to sponsor someone else after i get my citizenship...tht is this yr end..if i help my roomate will it affect me in anyways when it comes to me some sponsoring someone else say early next yr???
well some one else is my girl friend...just in case

Yeap, I don't get the 3 years thing either (are you confusing the 3 years tax return, perhaps?)...you must count the quantity of people (in this case are 3 in total for household size) and check the chart if you make the 125% over poverty level for the amount of people in the household.

That is my understanding...

i heard tht when u sponsor someone uscis goes through your 3 years income not just one...i have no clue if this is a myth or reALITY....so i was curious..
but my real query is if i help my roomate sponsor his wife will it affect me in any ways later when i want to sponsor someone...
i hear u r allowed to sponsor someone only once a year or once in two years..is tht right?

Oh okay...well, they were asking for your previous 3 tax returns, but that was before it is my understanding that now you just include the most recent one (there is a memo about it or in any case you can call the 800 number to verify it).

Even if they look at your previous tax history, currently you must be able to cover the 125% poverty line to be able to sponsor the person.

I haven't heard about what is the maximum people that you are allow to sponsor but I read about a case that the person had like 8 people in their family and the consulate asked for joint sponsor because even the person made over the poverty line, the consulate said that it was too many people for one sponsor.

But you are the USC or you are sponsoring someone else already? I can't recall...my memory is failing...upps! :)

i am not a usc yet,i am hoping to get naturlized this year...my roomate is a usc,thing is he is not financially sound..he is a nice guy,just want to help him out as a co-sponsor...
once i get my n400 approved i am planning to get married and get my lady here,thts only for a brief time though,we plan to get back once she gets her residency..just in case u know tomorrow something happens to me i dont want her to curse me for not giving her a chance to have a gc...
especially,since she has waited for me for almost 4yrs now
 
yeah...I think a smack on the face won't be nice though hehehe :)

If you make enough money over the poverty line even for a household size of 7 (just to make an example) you should not worry if you want to help your roomate...just remember that your obligation as a sponsor won't end even your roomate's love end on divorce and you cannot control or won't be aware of what others people do in their lives.

Lately they require only the last year tax return.

I don't think it should be like that...I'm pretty sure Bill Gates can sponsor 1 million people without any co-sponsor :D :D

Be careful, they get divorced and she's asking for welfare...you're liable for that...and even if they don't get divorced, if he can't support her, legally is your responsibility to take care of her...and if she never work and she doesn't accumulate 40 units with S.S. and she doesn't become an USC, theoretically you may have to liable for next...50 years :eek: :D :D

You need to meet/exceed the 125% minimum income requirement for only the most recent tax year. USCIS no longer requires for three years.

Again, it is only for the most recent tax year.
You can sponsor Gc for as many people as you can, as long as you meet/exceed the 125% minimum income requirement. But you have to remember that you are liable and responsible for them till they become a USC, have worked 40 quarters, or die. For every person you sponsor, the minimum income requirement bar is raised as the number of people you support increases. your income is 400 times the minimum now, it might drop down to 100 if you keep sponsoring more people.

i dont think there should be any problem. You are still responsible for your mother, and your mother will be responsible for your wife. If you are still not convinced, try asking your uncle to be a joint sponsor.
