i NEED Your Help; won the Lottery and i'm on a J1 !

hey there,
i'm in Real Trouble, actually i just got a Full scholarship to study in the US but the Visa in a J1, and i'm subject to the HRR 212 thing!
i just applied the other day for the J1, i'm still waiting for them to call me! but suddenly i get the congrats letter from the DV Lottery !
What am i supposed to do since i'm still in my home country ? and is there any chance the consulate ppl will know about me getting the lottery thing ? i am soo lost and i need a lot of help, plzzz
plus can i go there on a J1 and then apply there, i know it's gonna take a looonger time, but i'll apply As soon as i get there so i wont waster time ?
i hope the waiver thing wont be a problem since i have been chosen for the lottery ! what should I do ?

You do not have the visa yet. Until it is stamped in your pasport and they give you an approved IAP66 you do not have a visa.

Good for you. Stop worrying about the J-1 and start working on the DV paperwork. Talk to the embassy people. They can tell you what paperwork needs to be submitted. You are not the only one. There are probably 100,000 people that will get the letter, but only 55,000 visas available. And being in a different country is also more difficult with the mail and everything. The sooner you start the better, You do not want to miss the boat. Once they reach the 55,000 mark they will not accept any more applications. They sent out more letters than they have visas because some people apply for the lottery, but in the meantime get the greencard another way and there is no way for them to withdraw their name from the pool, that's why INS has to draw so many more names.

They are probably already notified.

I was in the US when I applied for the waiver (2 year homestay requirement) and it took me about 5 months before it was approved. And this was pre 9/11. Things take a lot longer now and are a lot stricter now.
What I am trying to say is do not waste time. Talk to the embassy people. You cannot have intensions upfront to apply for the waiver. The whole thing with the J-1 is an exchange visitor visa. You are not suppose to stay here indefinitely. After your study or research you have to go back home an x number of years (for me it was 2 )before you can apply to come to the US under a different visa.
i hope the waiver thing wont be a problem since i have been chosen for the lottery ! what should I do ?
If you read the instructions very carefully about the whole lottery it says clearly that winners of the lottery do not get special treatment regarding other immigration matters, which means that if e.g you need a waiver, you have to get it before you can do anything else. No exception.
So think it thru very carefully and make sure you formulate your questions very well when talking to the embassy people.
Just a weird question. Can't you get a regular F-1 visa????

you should be careful for this. If you applied for AOS or waiver as soon as you get to the US, you'll be in trouble as CIS may consider your J1 intent was not bona fide.
The safest is you do it at consulate and travel to the US after you get immigration visa, but you may not be able to be in the US before your study starts.. You may need to choose either of GC or J1 as you do not have much time to pursue both.

hey, i am going on a J1, the program is fully funded by the US department of State; so i know in this case that i cant stay, i'm subject to the 2 year home country residency,
But i think i can apply when i'll get there ! the waiver will take much longer time : but i dont care anyway !

You need to understand all the potential risk.

All the non-immigrant visa except for H1 and L1 is not allowed immigration intent. If you applied for AOS as soon as you get to the US on J1, they suspect you obtained J1 to get to the US to apply for AOS. if they consider that way, you will never see your Green card. You need to be very careful for AOS timing.. At least a few months after arrival.
Applying waiver as soon as you landed the US.... Not sure about this.

here is another risk.
if you already submitted DS-156 and J1 visa is in process now, you probably can get J1 visa. But if you did not do that yet, there might be some risk.
There is a question in Ds-156 asking if you have filed immigration petition before. The answer in case you only applied for lottery is, of course, NO.
Even though you won the lottery, answering no may be OK. But thing is consulate knows you applied for lottery and probably you won.

I read this story in other immigration board.
Someone went to consulate for their H1 visa, and he answered NO to immigration petition question in DS-156. Then at the interview, officer
turned computer screen to him and showed the lottery application he filed.
He was surprised to see his application was on the screen.
Officer said he had to answer yes to the immigration petition question in DS-156. But as most of you know, what officer said is not right. Just applying for lottery is not considered filing immigration petition. Anyway, that is not my point. My point is consulate knows your lottery application and most likely your winning. In case you won the lottery, how they handle you non-immigrant visa is hard to guess.

All i can say is that Consulate will definitely know you have won lottery.
Because i saw a genuine thread in another forum where applicant to apply B1 visa and was told of being selected for dv lottery even though the applicant had not recived the NL yet. Yes Consulates have visibility of DV Lottery selected applicants at least i would say for their region
 
All I can tell you to read my thread DV LOTTERY AND J1 VISA by afraid.

I came here with the J1 visa with the barrier of 2 years and I applied for a waiver and did AOS.

I am waitting for Third notice: interview appointment and name check.

Read the thread and if you have any questions ask and even call the national customer service to double check your information.
