Hello Guys,
how are you all? I have one question regarding one missing document.
I am very confuse about it:confused:. I applied for my husband dec 2010 and the case is also closed on June 27th.I have received an e-mail from NVC that I am still missing one doc which is W2 for 2010 which my husband will need to submit at the interview date. But I wrote an statement to the NVC stating that I never worked with check, so i never received W2 from my employer which is also told by an NVC agent when I called them.
After the case is closed I thought they wont ask for anything. But now they want to see it. What do I do?
I do not W2 but I have the the copy of TAX file of 2010. Will it be ok if I write another statement the same as I submitted like b4 with the I864?
Please please help me anyone if known.

Thanks for your time.

I did not understand off the book means. I was actually working with a construction company with cash by weekly. That means, I never worked in check so at the end of the year I would get W2 from them. But since I never got W2 i just filed Watever I wanted to show for that year. I told the USCIS that They company never gave me W2 because I got payment in cash. So they told me I will just have to write a statement saying that you got payment in cash not in check and you never received W2 because you worked in cash. I did write that and they accept it also they closed the case to. Now they said they want it at the interview. I called the NVC again to ask about it. I called 3 times and I got 3 different answer. One agent said wrtie the same letter that you wrote b4 to us, another person said contact with IRS and 3rd person said contact with you Employer. Now what should actually I do? I know if I contact with the employer they wont be able to give it to me neither. the only option left is to write the same statement that i wrote be.
Now just please give me an advice. please please.

Thanks

You need to speak to a good lawyer to handle this. From what I can get from your information it seems that your employer hired you as "off the books" meaning cash basis ,no taxes withheld no taxes paid etc. .

Maybe some of the more experienced members here see it better and have better answers for you.good luck

you know it's not legal to be paid in cash like that.
there are people that does it so that they don't have to pay taxes on the money that they earned, but like i said, it's not legal.
when you say the "case is closed on june 27th", what do you mean? was it approved or disapproved?
also, did you actually fill out section by section i-864 or as you say just "wrote a statement"?
i'm no expert but they still need some kind of proof that someone can support you financially so that basically you don't become a public charge and your statement saying that you get paid in cash is not one.

well, thanks for your answer. I think i couldnt write well to make you understand. My case is closed means it was approved and the case is already transferred to local embassy. we are just waiting for the interview. I had joint sponsored for him. so I864 part was fine. it went smoothly with missing one doc which is i said b4 is w2 for 2010. Yes i know it is nt legal to be paid in cash, but what will i do? i will have to work and get paid right? So, nw they want is W2 at the interview. so I thought If i write the statement as i wrote b4 will it not be enough? if anybody had any experience plz help.

Thanks again for all your support.
