I need information on H1B requirements.....please help!

Hi, everyone! I know those who are on H1B status can help. My immigration lawyer said that for H1B petition, one should have a Masters degree taken from a US university so I could avail a visa alloted for those with Masters. I am offered a teaching position in the US. I have 15 years of teaching experience and I have a Masters degree in Education taken in my home country. My US credential evaluation reports that I have a Masters equivalent degree in the US. Will this pass the USCIS requirement? Also, are there still available visas for master degree holders at this time? I need to be in the US as soon as possible as schools are about to open. We will be applying H1B on premium processing. Do I still have a chance? I don't want to miss the opportunity of working in the US. Please help me. Thanks in advance.

You are not eligible in that 20,000 MS degree slot. This is only for those who physically present in US and studied MS degree. No out side degree eqvlt is acceptable in this slot.

OCT is not for away, it is just 60 more days. Be patient, patient will reward alwaysin better way, Kabayan.
 
Thank u....thank u....thank u, great guru! In what H1b quota am I in if I wait till October? I am in a rush because my US school can't wait very long. They will surely fill in the position if I don't come until middle of September. I don't have chance anymore? :(
 
The October quota that Great Guru is talking about is the FY-2006 quota (65,000 visas alloted). U cannot start working until October 1st 2005 if you apply and get approved for that quota.

You are in the Year 2006 Quota, out of 65,000 visas already 28,000 exhausted. So you will get one if you apply right now.

What kind of school it is?

If they want great teaches like maovelina , they have to wait until Oct 2005. Good teachers will not be available in the Super Market shelf.

You made me laugh on that last post you did for me. I'd like to extend my sincerest thanks to you. Your every post brings additional hope and it makes me think more positive. I know you have done the same to so many people in need of answers they can't find anywhere. You give peace to many with bothered minds. You bring smiles to a lot of people in the morning or before they go to bed because they would feel lighter with your advice and information. With all these that you do here, GOD bless you more and more. Please continue to be an instrument of peace, joy and hope.

If its not too much yet for me to ask, please guide me about anything that u know and that i need to know and do in acquiring my H1B visa. This is my first to get such visa, my first trip ever to US. This means so much to me. I was denied J1 visa three times last year in 2 months through the same sponsor and for the same Virginia public high school. Now, a private high school offers me this job but they have not tried sponsoring anyone on H1B though they are willing to help in the documentation. So, together with a very good friend who is in VA we hired an immigration lawyer to do the petition for me. I need to be there mid of August but the principal knows my visa problem so she told me they will wait until mid of September. But you said, they will wait for me for physics teachers are not available in the super market shelf....thanks! I hope those in the school do!

Will my denial of J1 affect my H1B visa stamping at the Consulate office here in the Philippines? That's my another concern. Also, If H1b visa is approved can I go in September even if I have to start in October?

You did not give the reason for J1 rejection. (Tell me what happen during J1 interview process) My guess is J visas are for exchange visitors for higher education, physicians and research scholars. For Elementary or High School teaches, J is misused here.

You will definitely get your H1 approval here, visa stamping in Manila, I do not have any experience. You have to find out what counsel is looking for non-immigrant applicant. Though H1 has immigrant intent , scrutiny may not be so strict like F or B visa candidates.

Go to US embassy gate in the morning time or evening , different people will come out with smiling and sad faces. If you talk to them they will tell you the true story of their experience with counsel. No attorney can give this exp other than who had real interview with counsel. Try and post your experience.

Instead worring too much read/brush up Theory of Elasticity (Young Modulus), Kerchoffs law etc get prepared for young Americans in Oct 2005.
 
J1 visa denial

You are right about J1 visa. It is for exchange visitors. Teachers with J1 status act as cultural exchange educators in the US. I was rejected J1 visa for the mere reason of weak family ties. The consul suggested that I should upgrade my visa application. He did not say what type of visa but I guess it is like H1B. Weak family ties....I am a widow with 2 grown up kids (14 y/o and 17 y/0). I was 37 then and the consul thought that there are no great reasons which will pull me back home.

I seem to worry a lot because it is very depressing to lose a chance of working in the US. Again, you are correct when you said that there are smiling and sad faces, which are more in number, leaving the Embassy everyday. I hope to be among those with happy faces soon.

I am very excited about OCtober 2005. Thank you soooooo very much!
