I need Information and Help

I am from Chile and I've been here in USA since May 2002. I came with a tourist visa and staid longer than I should've staid (nov 1 2002). I'm geting married whith an american citizen, so I called USCIS and they told me that after we send the I-130 I have to go back to Chile and wait until my I-601 is accepted (arroud 1 year). I would like to know if that is the only way to process my green card or if I can do it without having to leave USA for a year and be away from mi wife... :confused:

Please check with an attorney, due to your over-stay (in US) will you get barred to re enter USA by INS.

It may affect your future plan.
 
If you are married to a UC Citizen you will be able to finish your Green Card processing in the US. However, due to your overstay, don't leave the United States before you processing is completed even with Advanced Parole.
 
Don't have to leave

Sometimes a call to the centers can be very misleading since ten different answers can be given on the phone on a single quetion. I know for sure that u can file both the I-130 and I-485 without having to leave. I know that leaving applies to undocumented but not overstaying (illegals). However, you can still seek advice from an attorney.
