I need an advice, please!

Hi All1
As I posted earlier my family was called for the fingerprints.
My youngest son now 15 years and he requires fingerprints to be done but he doesn’t have any picture ID. When we came to the US he was 4 years old and that time my country former USSR did not require photo for children under age 12 in a passport. I went to DMV to apply for ID and was asked for the prove of legal presents in the US. They advised apply for EAD. We did it and received a letter from INS : in order to process our request we need to send a copy of CA picture ID. Catch 22- we can not get ID because he doesn’t have EAD (or any other proof) and he can not EAD because he doesn’t have ID and without ID he can not be fingerprinted. I called to Nebraska INS , I called to our DMV and I don’t know what to do anymore. Any advice will be appreciated.

This is a bad situation.

Does he has a school ID?

Otherwise, write a letter to the NSC director and explain to him the whole situation.

Yes he has school ID but this is not a document for ins. I will write a letter, will see how it will help me.
Funny thing is I can not explaine it to my son. He was only 4, he spent all his life her , hardly speak his native language ( shame on me) and he has no rights here. My daughter was accepted to UCLA this year and it took me several phone calls and couple letters to explaine who she is. Isn't funny?

You should also contact DMV management people in Sacremento to see if they can help. Officials in other states are sometimes willing to waive the INS ID requirment in unique situations such as yours.
 
I did contact Sacramento DMV and they said they cannot do anything until I will presented a valid a valid INS document with picture ID. I sent a letter to NSC today with attached forms for EAD. will see if it will work, if not I'll send another one, but I am not going to leave them alone until I will get it from them. There should be a way around this ridicules situation

I extracted this from your state's DMV website. It says that you need only one of the listed documents and I recall you have an order from the immigration judge granting asylum. If you take the site literally, that is all your son needs.

Perhaps they changed the rules after 9/11 and did not bother to update the site. Check it out.

Gilbert, thank you for your advice but I've done it allready. They did not accept this document because it is a copy and they need an original with seal on it. I receivedit from BIA and I don't know whom should I contact to get an original.
