What will happen if i work when my EAD Expires(not too long max one month)How come they come to know that i worked in that period???


Please share.Any one who got 485 approvals in the past with same problem??//
 
I do not have 485 approved but based on other postings I have seen on this board, a relevant question would be :

What would you do when USCIS asks you why you were working with no authorization ?

Bottomline is please do not indulge in such activity. Stop working when you have no authorisation. As I have seen on this board the coorect approach is to get EAD in advance. If you have some sort of emergency you can attempt to get interim EAD. I am not aware of procedure but suchh a thing does exist.

 
At some point , may be during adjucation process or issuing new EAD they might notice that your visa or EAD expiered and there is gap between approval and expiration . And they can issue RFE asking about paystubs and W2 .
Bottom line is you can get away with it as long you not caught. If you worked for less than 180days , there is a way to survie. But if it is more than 180 days, you are in deep trouble.
 
they can aks for your tax returns if you are working for cash no way they can figure it out

better not to work... they may not catch you now, but you never know when they will send RFE... about pay stubs, h1 / ead / i94 papers.

my ead expired and im not working now as suggested... im ready to loose a grand now but not my green card for my future.

My only problem is i may loose this contract job.But job market is good i can get another.I am expecting my EAD by JAN15.Current EAD expires dec19. So i have to sit for a months.Good time for India trip...

Remember, they define work as getting paid.

My friend transferred sites within a company and didn't get the H1-B approved in time. She kept working, but didn't get a pay check. When the H1-B finally came thru, they paid her back-pay.

I guess it depends if you trust the company enough.

If it is less than a month or two it is hard to get caught

but it is always possible. If it is a contract job, you can ask your employer to pay you after you receive your EAD.

When it comes to approval , they ask for your employment verification and tax document and recent pay stubs. But I never heard that they asked to produce the paychecks from specific period. if you show a yearly tax returns how can they say you worked in a specific month in a year or not. I would say if it is for short time and you have a way to work around . you could get away with it

w2 can exceed the specified amount in labor or offer letter because of bonus/incentives. Assume you got 5k bonus but you didnt work for a month where your salary was 3k ? Your w2 will have 2k more than your labor/offer.

Ill say paystub is critical which will help to show the difference in pay which is also not a fool proof because your employer may have paid you in someother means.

so it is purely based on combination of your valid documents. Bottom line is you have to prove that you didnt work.
