I know it is a strange question: I got a message from a colleague who works in another company and who will start with the EB-1 (outsanding researcher) process soon that the compnay would like to start the process before end of february because then some changes in the process are expected to start. My colleague tries to get more information about that but did anybody heard something about any kind of changes that are planned for the EB-1 process ?

Hopefully, after February they will start approving in 6 months and give some meaning to this outstanding category!!!

Anyways, no, I've not heard anything ....

Just to let you know. I found now out that the HR department was not refering to the E1-B process but to the RIR process.
According to their immigration attorneys (very big and well known company) they were informed that the PERM process should be finally started end of next february.

My own personal advice to people is to get started as soon as possible. Any delay could be costly. They've been promising this PERM thing for *YEARS*. I'm holding my breath. Please let me know when I can exhale. Starting.......

Do you think that PERM will make the whole process easier/shorter or longer/more diffcult. I heard different opinions from a lot of people and I am curious what your opinion is.

PERM refers to the new automated system for labor certification. Admittedly, I don't know much about it since I did EA, which bypasses LC. It is supposed to be faster than the present system. A gov't agency learning to do things more efficiently sounds far-fetched.

My problem with PERM is one of experience with the LCA faxback system that was instituted in 1998. Prior to the faxback system, to apply for an LCA to file an H-1 it was necessary to send the forms to DOL and have them approved and sent back. Then the faxback system came into existence and it worked sporadically for about 2 years. Then in 2000 they decided to "fix" it. That took the system out of commission for about 3 months. For 2-3 months it was impossible to obtain any certified LCAs to file an H-1. Then, finally, about 2 years after it first came into existence, it started working properly and now it is possible to obtain an LCA almost instantaneously via a web based filing system, however, that took nearly 4 years to get working correctly.

The difference in complexity between an LCA (form ETA-9035) and an LC (forms ETA-750A and ETA-750B) is enormous and I consequently do not have much hope that PERM will function effectively anytime in the foreseeable future. I hope that I am wrong.
